Civil servants form the backbone of Indian administration. They implement laws, deliver public services and maintain continuity in governance. Sardar Vallabhbhai Patel called them the “steel frame of India.”. However, they do not function like ordinary citizens in all matters. They are guided by service rules, conduct rules, discipline rules and constitutional provisions. Therefore, the statement that “civil servants are dictated by rules and procedures” is largely true, but it must be examined along with the rights and protections available to them.
Civil Servants and Rules and Procedures
Civil servants work under a rule-based system because public administration needs neutrality, accountability and discipline. For example, the All India Services Conduct Rules, 1968 and Central Civil Services Conduct Rules, 1964 regulate their behaviour, political neutrality, public statements, gifts, financial dealings and use of official position.
Moreover, civil servants must follow hierarchy, written procedures, financial rules and administrative guidelines. This prevents arbitrariness and promotes fairness in governance. As Sardar Vallabhbhai Patel said, “The civil service must be above party.” This highlights the need for neutrality and discipline in public service.
However, civil servants are not without rights. The Constitution and service laws provide them several protections.
Rights and protections of civil servants in India:
- Constitutional protection under Article 311: A civil servant cannot be dismissed, removed or reduced in rank by an authority lower than the appointing authority. Moreover, they must get a reasonable opportunity of being heard before major punishment.
- Equality before law: Civil servants enjoy rights under Article 14 and Article 16, which protect them from arbitrary action and ensure equality of opportunity in public employment.
- Right to legal remedies: They can approach courts under Articles 32 and 226. They can also approach tribunals like the Central Administrative Tribunal, established under the Administrative Tribunals Act, 1985.
- Right to salary, pension and service benefits: Civil servants have legal claims to salary, pension, leave, promotion consideration and other service benefits as per rules.
- Protection against political pressure: Rules and procedures also protect civil servants from arbitrary transfers, victimisation and unfair disciplinary action.
At the same time, their rights are not absolute. They face reasonable restrictions. For instance, they cannot freely participate in politics, criticise government policy publicly or disclose official secrets. The Official Secrets Act, 1923 and conduct rules restrict such actions.

Thus, civil servants are indeed governed by rules and procedures, but these rules are not only instruments of control. They also protect civil servants from arbitrariness and political misuse. Therefore, a balanced framework of discipline, neutrality, rights and accountability is essential for an efficient and democratic civil service.
